Starting January 1, 2026, fines for low-quality construction materials have increased in Ukraine. This concerns products that are put into circulation in violation of technical legislation requirements. The primary reason for these changes is the increase in the minimum subsistence level for able-bodied individuals. This indicator is used as the basic value for calculating financial penalties in the field of construction products.
▪️A fine of 126 minimum subsistence levels is provided for violations of quality and safety requirements for construction materials. In 2026, this amounts to over 419 thousand UAH for each individual model, article, or batch of products. Importantly, the fine amount does not depend on the volume of sales or the number of retail outlets where the product was sold.
This mechanism makes even a single violation economically significant for the manufacturer and increases the cost of the risk of non-compliance with standards.
▪️The manufacturer remains the key responsible party for ensuring that the products comply with technical regulations. The law requires ensuring:
correct declaration of product indicators;
labeling with the conformity mark;
compliance of actual characteristics with the declared ones.
▪️Distributors of construction materials must act with due diligence and verify the accompanying documents for the products. In case of doubts about the product's compliance with legislative requirements, they are obliged to refrain from selling it.
